These Terms of Use (“Terms”) govern your access to and use of the Testronaut Companion App (“Mission Control”), the Testronaut CLI, our website, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility & Accounts
- You must be at least 13 years old (or the age of digital consent in your region) to use the Services.
- You are responsible for maintaining the confidentiality of your account and credentials and for all activities under your account.
- Provide accurate information and keep it up to date.
2. Acceptable Use
- Do not abuse, interfere with, or disrupt the Services or other users’ access.
- No reverse engineering, scraping, unauthorized access, or circumventing security controls.
- No uploading of malicious code, illegal content, or content infringing others’ rights.
- Respect rate limits, API keys, provider terms (e.g., OpenAI, GitHub, Google), and third-party website/app terms when running missions.
3. User Content
You may upload mission reports, logs, screenshots, and other materials (“User Content”). You retain your rights in User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process User Content solely to operate and improve the Services. You represent that you have all rights necessary to upload and license your User Content.
4. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Services, you consent to our data practices as described there.
5. Subscriptions, Trials & Beta Features
- Some features may require a paid plan. Prices and features may change with notice.
- Trials or beta features are provided “as is”, may be limited or disabled at any time, and may collect feedback to improve the Services.
- You are responsible for any third-party provider fees (e.g., model usage) when you bring your own keys.
6. Third-Party Services & Links
The Services may integrate with third-party tools (e.g., authentication providers, model APIs, hosting, analytics) or link to third-party sites. We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and policies.
7. Intellectual Property
- The Services, including software, UI, design, and trademarks, are owned by us or our licensors and protected by law.
- These Terms do not grant you ownership of the Services or any content other than your User Content.
- Feedback is welcome and may be used by us without restriction or obligation.
8. Service Changes & Availability
We may modify, suspend, or discontinue any part of the Services at any time. We aim for high availability but do not guarantee the Services will be uninterrupted or error-free.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ARE RESPONSIBLE FOR HOW YOU USE OUTPUTS, INCLUDING IN TESTING OR PRODUCTION.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR AFFILIATES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS PAID BY YOU (IF ANY) FOR THE SERVICES IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
11. Indemnification
You will defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Services; (b) your User Content; or (c) your violation of these Terms or applicable law.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your access immediately if you breach these Terms, pose a security or legal risk, or if required by law. Upon termination, your right to use the Services ends. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity) will survive.
13. Governing Law; Dispute Resolution
These Terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Alberta, Canada, for any dispute arising out of or relating to the Services or these Terms.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a revised “Last updated” date. If changes are material, we may provide additional notice. Your continued use after changes become effective constitutes acceptance.
